Environmental non-compliances reported by affected communities, the media, & NGOs

In response to a PAIA request submitted by the CER for records indicating the names of mines and industrial facilities in respect of which notices or directives under the National Water Act have been issued, the DWS responded with information which indicated that:

  • The Glencore Merafe Venture had been issued with a notice on 10 March 2015;
  • XCSA (Xstrata Coal South Africa) Tweefontein Division was issued with a notice on 23 February 2015;
  • Middlekraal Colliery was issued with a notice on 10 June 2014. Middlekraal is owned by Shanduka Coal, which is 49.9% owned by Glencore;1 and
  • Umsimbhithi mine was issued with a notice on the 12 August 2014. Umsimbhithi is owned by Umcebo, which is 43.66% owned by Glencore.2

In 2014 it was reported that the Federation for a Sustainable Environment had laid a criminal complaint against the directors of Glencore due to non-compliance with environmental regulations. Glencore Xstrata spokesperson Gugulethu Maqetuka said in response that “the complaints have been brought without justification” and that “the mine in question operates within all the requirements of the National Water Act”.3
